Origin and History

California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (commonly referred to as “Prop 65”) is a state law that requires manufacturers and retailers to label products when certain chemicals are present in a product that have been identified by the State of California to cause cancer or reproductive harm. California rarely conducts any independent scientific review to determine if any of these chemicals cause cancer or reproductive harm. Typically, chemicals are automatically added to a list (which has now grown to over 900 chemicals) when a report or scientific body makes a finding that shows a possible correlation between the chemical and the potential harmful effects. This law has resulted in an overwhelming amount of litigation, which is very challenging for manufacturers to deal with. The law offers a “safe harbor” for manufacturers that use the recommended warning language on their products and as such, many manufacturers have taken advantage of this “safe harbor” and added the warning language to its products.

APPLICABILITY TO LIFETIME

Why is it Required on Lifetime Products?

The Prop 65 warning is required on all Lifetime products because all of our products contain steel or stainless steel components. All types of steel contain a chemical called nickel, which has been deemed by California to potentially cause cancer, and is “under consideration” for causing reproductive harm. Nickel is present in all steel (not just Lifetime’s steel) and in higher concentrations in stainless steel. All Lifetime products are rigorously tested for chemical content that could be harmful. All Lifetime products meet or exceed every relevant, industry-accepted safety standard including all applicable federal laws and industry standards. Lifetime is unaware of any case of any person contracting any form of cancer or reproductive harm of any kind by simply handling or touching steel (or otherwise using our products for their intended use). California law mandates that consumers need to be made aware of these risks and because of this mandate Lifetime has added the Prop 65 warning language to assist consumers in making these informed decisions.
